BELOW ARE THE TERMS AND CONDITIONS THAT HAVE BEEN CAREFULLY WRITTEN AND PLACED TO PROTECT YOU ("THE CLIENT/CUSTOMER") AND MYSELF ("SO VISUAL CREATIONS"). IT IS RECOMMENDED THAT YOU VIEW THESE TERMS PRIOR TO PURCHASING ANY DESIGN SERVICES.By registering for any Services, you are accepting this Agreement and you represent and warrant that you have the right, authority, and capacity to enter into this Agreement.

 

SERVICE RENDER

 

 SO Visual Creations agrees to produce project materials such as any logo and backdrop design at the request of the client for fees and delivery of the Design by an agreed-upon deadline. A Non-refundable deposit is required before booking for any design service and before any work begins. As long as the client provides the designer with all information, on the Design Form within the allotted time frame so work doesn’t prolong.SO Visual Creations will be the sole author of the any work.

COMPENSATION

 

 The client agrees to pay SO Visual Creations 100% of the total cost of  the Design Service.A Non-refundable deposit of $25 Is required for backdrop and $15 non-refundable for a logo before any work begins.Currently, payments are all made via Paypal or Cashapp at this time.Click Make Payment Link Below.

 

 

COMMUNICATION

 

We typically contact you when the first drafts are prepared for any design service.We communicate via email at sovisualcreations@gmail.com.If you need to be contacted by phone for any reason, I will reach out.Please allow 24-72 business hours for a reply to your inquiry. Inquiries will not be responded to on the weekends/holidays.

REVISION

 

There is a three (3) free minor revision limit ( color, font, placement). After that, all additional revisions will incur a $10 fee per revision. We will not produce any other concepts out of the 1-3 we've already designed, you must choose one (1) design to revise UNLESS a new design has been purchased. This is to ensure a steady workflow so your project can be completed in a reasonable time frame.Keep in mind additional revision will prolong the turnaround timeframe.

 

 

CREATIVE CONTROL

 

It's Imperative to fill out the design form.In the event that you are unsure of the ideal design, we are here to provide our services through Creative Control. What this means is that you relinquish all designing rights to SO Visual Creations to present the best design based on what image your logo (brand) or backdrop (theme) should have/represent. As for your design, the following will apply:

- Full designer control

- One Concept

- Limited to 1 revision 

 

ROUGH DRAFT OWNERSHIP

 

Rough draft images of ANY kind are for the purpose of approval only. They may not be copied, manipulated, or distributed to any other person or company other than those directly involved with the project without prior permission from SO Visual Creations. All drafts works are the property of SO Visual Creations.

 

TURNAROUND TIME

 

The estimated standard turnaround time for a design is between 7 - 14 business days (not including weekends/holidays). Turnaround time starts after all information from the design form has been filled out and deposit/full payment is received.Delay in us getting all the information necessary can result in a delay in your design being completed in the time frame mentioned above. Keep in mind additional revision will also prolong the turnaround timeframe as well.For logos. *Rush Order (3-5 Business Days) additional fee of $25. 

 

 

BACKDROP SHIPPING

Once final backdrop design is approved by client, the backdrop will be sent to print.The backdrop will be shipped to the address that was provided on the design form.Please allow an additional 5 - 9 days business days (not including weekends/holidays) to receive backdrop.

CLIENT’S RESPONSE TIME & TIME FRAME

 

 “The Client” must provide all information requested for any Design Service in a timely manner. If there is a delay on your behalf, the completion date of your project then changes.  

If “The Client” fails to respond for whatever reason, we will mark the project incomplete, forfeiting the initial deposit. This is called going "ghost".

 

After 14 days of no communication, there will be a $25 restart fee. After 30 days, your design (deals, credits, and/or free offers) is forfeited, and no refund shall be issued. Your entire project is now canceled and any design will be removed from the queue.Any time your project comes to this extreme decision, our company will no longer do business with you or your brand.We know certain information takes time to acquire to email us & we also know life happens, which we respect and will place your project to start later than scheduled if communicated. All we ask is to be courteous & keep in contact and reiterate that you need more time to gather information for the design and/or to submit changes during the revision stage.

 

 

 

CONTENT DELIVERY FILES/POLICY

 

Logo Drafts will be sent by email (sovisualcreations@gmail.com) .After the final logo design is approved, the logo will be sent to you by email as a digital file in the following formats: (.jpeg, .pdf, .png).Backdrop Design Drafts  and approval will be sent by email (sovisualcreations@gmail.com) Backdrop will shipped to the address that was provided on the Backdrop Design Service Form. For backdrop shipping, please allow additional 5 - 9 days( not including weekends/holidays) to receive backdrop.

 

 

CANCELLATIONS

 

If for any reason you want to cancel a service already rendered or paid for, that is your choice. However, due to the work produced or in queue, payments already received by SO Visual Creations will not be refunded in order to offset the loss of business.

If partial work has already been received by the client and they choose to cancel, the partial or full payment that has been paid will not be refunded. Ownership of all artwork, layouts, and development will remain the property of SO Visual Creations and remaining work will not be sent to the client for their ownership. If the project is in its final stage, ownership will be transferred to the client after full payment is received.

 

FAILURE TO PERFORM

 

If  SO Visual Creations is not able service your design due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond their control, then SO Visual Creations will return any fees paid by Client and will have no further liability with respect to this Agreement.

 

 

REFUNDS

 

Deposits and payments are 100% Non-Refundable.Due to the fact that we provide a custom service, the time that it takes to create designs is non-refundable. Our time is valuable and so is yours so please communicate professionally and responsibly of your design expectations.Once Design Service is complete, SO Visual Creations does not provide refunds for any services unless agreed upon. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund.

 

TERMS OF SERVICE

 

The client has 14 days to respond to our emails. After this grace period, the order will be terminated, and the client will have to pay a restart fee of $25. Waiting on responses/decisions hinders us from closing out projects and moving on to new clients. We understand that life happens. Just openly communicate that with us. Trust, we will do our best to work with you. The client has the right to terminate this agreement if, SO Visual Creations fails to fulfill service requests within the given turnaround time. SO Visual Creations also has the right to terminate this agreement and retain payment if a client becomes verbally abusive, unreachable, procrastinates, and absurd. 

**This agreement can also be terminated by SO Visual Creations for the following reasons:

 1. Rejection of several designs without giving sufficient criticism or suggestions, leaving the designer to guess what they dislike (“ I just don’t like it.”  "I don’t know what’s wrong".) 2. Makes unreasonable requests, usually with delivery time (“I would like four different versions of the backdrop/logo by tomorrow night, thank you!”)
