BELOW ARE THE TERMS AND CONDITIONS THAT HAVE BEEN CAREFULLY WRITTEN AND PLACED TO PROTECT YOU ("THE CLIENT/CUSTOMER") AND MYSELF ("SO VISUAL CREATIONS"). IT IS RECOMMENDED THAT YOU VIEW THESE TERMS PRIOR TO BOOKING ANY PHOTOGRAPHY SERVICES. BY BOOKING FOR ANY SERVICES,YOU ARE ACCEPTING THIS AGREEMENT AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THIS AGREEMENT.

 

 

SERVICE RENDERED

 

As a Photographer, my goal is to executed the photography assignment in a professional and competent manner, with producing high quality photos for the client. Client agrees to pay Photographer all fees and expenses in connection with any service that is booked.

SERVICE COVERS

 

Price including all “non-tangible” portions of the photography session. This includes, but is not limited to The Photographer’s TIME: time spent PREPARING for shoot, time spent DURING the shoot, and time spent EDITING the shoot. Preparing: Includes but is not limited to time e-mailing, setting up studio (bringing out necessary props, reconfiguring lighting for shoot, The use ). During Shoot: Standard Sessions in studio up to 2 hours, Standard Sessions on-location includes travel time. Post-Production: Each photo takes approximated 20-30 minutes in post processing. Every full session includes may include up to 50 edited proofs depending on the service you booked.  Also  the use of equipments (including but not limited to memory cards, lighting, light stands, diffusers, light bulbs, beanbag poser, props, camera, lenses, and editing equipment).

 

COMPENSATION

 The client agrees to pay SO Visual Creations 100% of the total cost of Photography Service.The Client shall make a non-refundable deposit to retain the session date.  If you cancel, your retainer is forfeited and may not be applied to another session.  If you do not cancel and the photographer arrives at the location of the session or event, you will be responsible for paying the remaining  balance. There refund after a service is rendered or having buyers remorse.

CANCELLATIONS

 

For Cancellation, as  a courtesy please let me know at least 2 days before if possible, we understand life happens. It’s just a courtesy to reach out instead of going “Ghost”. If you cancel services or event, your deposit of $25 is forfeited and may not be applied to another session or event.If cancellation on my end, a refund will be paid back to client.

 

COMMUNICATION

You will receive a confirmation email confirming the appointment or event date.Another email for appointment reminder. You would also receive an email when photos are ready.For updates or question regarding your photography service, contact us via email at sovisualcreations@gmail.com or through this website.

 

TURNAROUND TIME

 

The estimated turnaround time for photos to be ready is between 7 - 14 business days( not including weekends/holidays). 

 

RESHOOTS

 

If Client requires a reshoot, Client will pay Photographer an additional fee of one hundred percent of the fee stated in the booking service for the original shoot.

 

If a reshoot is required due to factors beyond the control of Photographer, including but not limited to, weather conditions, or acts of God, Photographer will not charge an additional fee  for the reshoot.

 

 

FAILURE TO PERFORM

 

If Photographer is unable to supply his photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, then Photographer will attempt to procure the services of another professional photographer to fulfill his obligations. If that does not succeed, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.

 

This limitation of liability will also apply in the event that any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of Photographer.

DELIVERIES & ARCHIVING DIGITAL FILES

 

While Photographer may choose to archive the Image(s), it is Client’s responsibility to properly store and archive the Image(s). Photographer cannot guarantee the availability of any Image(s) beyond the date of first delivery to Client.All digital files created by, or on behalf of, Client that contain any Image(s) will be deleted  within 2 months.  This is to make space for other client’s photos, and also to give clients enough time to download them.Images will be upload to either Google drive , Dropbox, or a either gallery portal for downloads to your computer or usb.

 

DIGITAL FILE QUALITY

Photographer is committed to providing high quality services. Unless otherwise specified, Photographer may deliver, and Client agrees to accept, the Image(s) encoded in an industry-standard data format that Photographer may select, at a resolution that Photographer determines will be suitable to the reproduction technology and use(s) for which the Image(s) is licensed.

 

Photographer uses cameras and monitors that are color calibrated to industry standards. But due to variances in other monitors, software and computer platforms, the Image(s) may display differently on other monitors. Therefore, neutrals will be set for mathematical neutrality and color will be adjusted for pleasing tonalities.

 

 

SESSION LOCATIONS

Sessions will be conducted at a location agreed upon by the photographer.  The photographer will not trespass or use any property/locations that is considered unlawful to do so.  The photographer is bound by any rules states for the property or location.  If the Client wishes to shoot on private property it is the Clients soul responsibility to get authorization from the owner of the property.  The photographer is not responsible for hazards at the location and the Client agrees to enter into the session at their own risk. Indoor Session, is done at my home studio.Address will be provided once indoor shoot is booked.

 

Facebook Sharing and Other Social Media

​

It is understandable that the Client might want to post their new photographs on the Internet via Facebook, Twitter, Tumblr, Instagram, and/or any other social media outlets. This agreement will serve to allow posting low-resolution or high-resolution photos to social media sites, only in the case that SO Visual Creations is credited and that photos are NOT altered with editing or filters. Additionally, it is understood that the client will NOT remove, or have removed, watermarks from Internet images Brandy McShan Photography has uploaded to Facebook or her website, or from the low-resolution images offered for free to clients who have purchased prints.

You are permitted to click the “share” button on any photos posted to Graceful Shutter Photography ’s facebook page.
